What is a California 20-day Preliminary Construction Notice?

If you hire a contractor and that contractor e.g.

• Hires a subcontractor
• Buys material for your project
• Rents a machine to work on your project

The company that supplies the material or service can notify you of this with a 20-Day Preliminary Construction Notice.
That way they can put a lien on your property if they are not paid by the person who you hired.

In other words, you might have paid the contractor, but he did not pay the subcontractor or material supplier and you might have to pay again!!

The California Preliminary 20-Day Notice states that the subcontractor or supplier has provided or will be providing goods and services to improve your property and could file a lien claim if they are not paid.

If you ever do any construction in California, you are likely to get some “Preliminary 20-Day Notice“. Basically a way for contractors and their sub contractors to get money from you by pulling a lien on your property.

It can be especially surprising if you get the notice from a supplier or subcontractor that you are not even aware off. Anyway, when you get one and you have paid the contractor, make sure you have them sign a “Waiver of Lien”. I am using this form “FULL UNCONDITIONAL WAIVER“.

Once you have completed the project, I have also started to have contractors sign a “FINAL RELEASE AND WAIVER OF LIEN” form. Please use these forms at your own risk - you may want to have a layer review the forms; but a bad form is still better than none at all.
